GENERAL

we take orders for pizza and drinks via our premises or website (https://pizzabutlers.com/).  We do not take telephone orders.

Please read these terms and conditions carefully before ordering as these terms will apply to any orders you place.

By placing an order, you agree to be bound by these terms and conditions. If you do not accept these terms and conditions, you should not place an order.

Your use of our site, and any orders you place, is governed by our Terms of Use, Privacy Policy and our Cookie Policy. Please take the time to read these, as they include important terms which apply to you

SERVICE

We advise placing your order early, our website takes orders 1 day in advance.  Our website will offer you 15 minute timeslots.  Once the timeslot has met its threshold of pizza orders that timeslot will be removed from the selection.  Once all the slots are full or its too late to order on the night you will be offered the next available timeslot which will be the next day.  Please read carefully what time you are booking your pizza, we have had customers booking a pizza for delivery the next day by mistake.

You must order a pizza to claim delivery we will not deliver drinks without a pizza order. We offer a delivery service to the Sidmouth Town Sidbury & Newton Poppleford area. Rural customers will need to collect their order.

Our butlers will only deliver to the main door when delivering to apartment blocks, flats or hotels and they carry less than £10 in change.

ORDERING

You may only place orders if you are at least 18 years old. By ordering, you warrant that you are at least 18 years old and you are legally capable of entering into a binding contract.

When you place an order via our website, you will be presented with confirmation on your screen that your order has been received and accepted.

When you order a delivery, you must first place your post code into the address field on the home page or on top of the menu page.  when you click the tick the system will say whether you are inside the delivery area.  We have a very limited delivery zone.  If you push an order though the system to an address outside the delivery zone you will be either have your order cancelled, be telephoned to request collection or we will deliver subject to a £30 penalty charge.

You will receive an email confirming your order. Please make sure that the email address, home address and telephone number you provide are correct and in proper working order, as these are required to fulfil your order.  Should you place a delivery order for a completely different address to where you actually live you will pay a surcharge fee of £10. (Yes it actually happened more than 1 miles away)

If you place an order at our site, your contract will be formed when you receive your receipt of purchase.

PRODUCTS

Our products are subject to availability. Should we run out of some ingredients we will try to contact you by phone, otherwise we will fulfil the order with as close a substitute as possible. If you are unhappy with this please ask our butler for a remedy.

We do not use nuts in our kitchen, however, some ingredients are produced with nust and some products are made in factories that handle nuts.  Therefore it is possible that a nut could have fallen into another product however unlikely.  Allergens are listed on our menu to ensure you can make the best choice.  Please ask a butler or call us to ensure zero mistakes or misinformation occurs.

We can be very busy and there is a risk of cross-contamination between toppings. If you have an allergy we kindly ask that you leave a comment for the pizza butler in the comment box as you order. If we have a problem understanding your order we will phone you.  Please have your phone available to take a call.

We have veg options available on our menus. We also have procedures in place for making pizzas that are suitable for vegetarians which are processed on a separate paddle, however please note that we do not have a dedicated oven to cook vegetarian food. All pizza's are cooked with a naked base on our stone base inside the authentic wood fired oven.  We have consulted public health officials and are not capable of making gluten free pizza's.  The reason is that pizza's are baked on the oven floor and it isn't possible to have a second oven running as there are not enough orders for gluten free.

We try to provide the best chemical free ingredients and organic vegetables in our pizza.  We also follow the principle of buying locally wherever possible.  If we cannot find local or organic then we will buy the next highest quality ingredient. please ask if you have a particular preference.

Our pizzas are handmade artisan made to order with fresh dough. Images of our products on our menus are for illustrative purposes only. Although we try our hardest to be consistent, at times, the size of the bases can vary and products you order may vary slightly from those images.

AVAILABILITY AND DELIVERY

We strive to maintain on-time delivery of your order. However, unfortunately, things do not always go to plan and especially in peak times staff shortages, lots of small orders and problems with woodfired oven can delay delivery.

Should you be unsatisfied with your order you can follow the standard process available to all customers and contact our butler and ask for a remedy.  We welcome complaints because it gives us an opportunity to put things right that we didn't know were unsatisfactory.  You are always welcome to call 07508668636 and speak to the business owners Robert or Anjing.

Delivery isn't easy. We like to deliver our pizza ourselves as it allows us to maintain high standards and ensure that you are delivered a piping hot pizza.  Please bear with us if we take a little longer than is normal.  We do not guarantee our delivery times.

CANCELLATION

You have the right to cancel an order by telephoning 07508668636 if it hasn't already been made. If you wish to cancel an order after food has been used or we started preparing you need to ask a butler for a special consideration. You don't have the right to cancel and order unless the product is not fit for purpose.

In the unfortunate event that we need to cancel your order after it has been accepted, we will notify you.

If you do not provide a valid telephone number on your order, that order will be cancelled without further consultation with yourself.

You will not be charged for any orders we cancel. Any payment made prior to an order being cancelled by will be reimbursed using the same method originally used by you to pay for your purchase.

PRICE AND PAYMENT

Prices are as quoted on our menus.

Payments are made directly to us via Debit or Credit cards (Square), PayPal or cash.

OUR LIABILITY

We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable.

We, do not exclude or limit our liability for:

  1. death or personal injury caused by our negligence;

  2. fraud or fraudulent misrepresentation; or

  3. any liability which cannot legally be limited or excluded.

WRITTEN COMMUNICATION

We will contact you by email or text message to provide you with information or by posting notices on the website. For contractual purposes, you agree to electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (a "Force Majeure Event").

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond both our reasonable control and includes in particular (without limitation) the following:

  1. strikes, lock-outs or other industrial action;

  2. civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

  3. fire, explosion, storm, flood, extreme snow, ice, earthquake, subsidence, epidemic or other natural disaster;

  4. impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

  5. impossibility of the use of public or private telecommunications networks;

  6. the acts, decrees, legislation, regulations or restrictions of any government; or

  7. non-performance by suppliers or subcontractors.

SEVERABILITY

These terms and conditions operates separately. If any authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

VARIATION OF THESE TERMS AND CONDITIONS

We have the right to amend these terms and conditions from time to time. Changes we make to these terms and conditions will be posted on this page. You are subject to the policies and terms and conditions in force at the time that you place your order.

THIRD PARTY RIGHTS

Only parties to these terms and conditions shall have any right to enforce any of these terms and conditions.

LAW AND JURISDICTION

Disputes or claim arising out of or in connection with your order will be governed by English law and the Exeter Magistrates Court.
